Booking Terms and Conditions

Thank you for choosing Carl Bingham Property Presentation.
Our goal is to provide a professional, reliable and consistent experience on every project. These Booking Terms and Conditions set out the contractual agreement that applies when booking our services.
By confirming a booking with Carl Bingham Property Presentation, you agree to the following terms.
Where terms differ between business clients (B2B) and private vendor clients (B2C), this is clearly indicated.
1. Booking Confirmation
A booking is confirmed once it has been accepted by Carl Bingham Property Presentation in writing, including by email or message.
The agreed appointment date and time will be reserved exclusively for your property.
All bookings must be made with a minimum of 48 hours notice to ensure adequate preparation time.
2. Services
Services may include but are not limited to professional property photography, aerial drone photography, professional 360 virtual tours, floor plans, cinematic video and presenter led video walkthroughs.
The services to be provided will be confirmed at the time of booking or quotation.
All quotations are valid for 30 days unless otherwise stated. Additional services requested after a booking has been confirmed may incur additional charges. Travel outside our standard operating area may be subject to mileage charges which will always be agreed in advance.
3. Cancellations and Rescheduling
We appreciate that plans can change. The following charges apply.
More than 72 hours notice — no charge, reschedule free of charge subject to availability.
Between 24 and 72 hours notice — 25% of the agreed booking fee.
Less than 24 hours notice — 50% of the agreed booking fee.
Same day cancellation or cancellation after travel has commenced or upon arrival on site — 100% of the agreed booking fee.
Each case will be considered on its merits at our sole discretion.
4. Property Access and Preparation
The client is responsible for ensuring that access to the property is available at the agreed appointment time. A delay of more than 30 minutes may result in the appointment being treated as a late cancellation at our discretion.
To achieve the best possible results the property should be fully prepared before the scheduled appointment. This includes cleaning throughout, beds made, curtains and blinds opened, appropriate lighting switched on, personal items and clutter removed and outdoor spaces presented. A pre-shoot preparation guide is available on request.
Minor adjustments may be made during the appointment however Carl Bingham Property Presentation is not responsible for cleaning, staging or preparing the property.
5. Weather and External Conditions
We will make all best efforts to schedule shoots on dry and clear days suitable for both interior and exterior photography. If weather conditions on the day prevent exterior photography we will discuss options with the client which may include completing interior photography only and returning for externals. A return visit fee will apply, quoted at the time based on travel and time required.
Drone photography is subject to safe flying conditions and CAA regulations. If conditions are unsafe for drone flight on the day a return visit for drone only may be arranged. A return visit fee will apply, quoted at the time based on travel and time required.
6. Drone Photography
Carl Bingham Property Presentation is a CAA registered drone operator and holds appropriate insurance for commercial drone operations. All drone flights are conducted in accordance with CAA regulations and the UK Drone Code.
Drone flights are subject to UK Civil Aviation Authority regulations, airspace restrictions, temporary flight restrictions, weather conditions, GPS availability and site safety assessments.
The client is responsible for ensuring drone flight is permitted at and around the property. Carl Bingham Property Presentation will conduct standard airspace checks prior to every shoot. However if restrictions exist that were not made known before the shoot this will not be grounds for withholding payment. The full invoice remains payable regardless of whether drone operations were possible on the day.
Where a client knowingly provides incorrect information regarding airspace permissions the full invoice remains payable and Carl Bingham Property Presentation accepts no liability for any resulting legal or regulatory consequences.
7. Image Delivery and Turnaround
Standard delivery times are as follows.
Photography and drone — 48 hours from completion of shoot.
Floor plans and 360 virtual tours — 48 hours from completion of shoot.
Cinematic video and presenter led video — 72 hours from completion of shoot.
Express delivery is available at an additional charge and must be agreed in writing before the shoot takes place.
Images, floor plans, virtual tours and other agreed deliverables will be supplied digitally via a secure online download link.
8. File Formats and Working Files
All photography is delivered in high resolution JPEG format unless otherwise agreed in writing before the shoot.
No RAW files, PSD files or working files will be provided as standard. These are proprietary working files that form part of our editing process and are not included in any package.
If alternative file types are specifically requested and agreed in writing before the shoot these may be provided at an additional charge. Any alternative files supplied will be flattened and will contain no layers, metadata or editing methodology.
Floor plans are delivered in PDF and JPEG format. Drone footage stills are delivered in JPEG format. Video is delivered in MP4 format.
RAW files, unedited images and rejected images remain the property of Carl Bingham Property Presentation and are not supplied under any circumstances.
9. Re-Edits and Additional Amendments
One round of minor amendments is included as standard with every shoot. Minor amendments are defined as small object removal, dust spot removal and minor exposure and white balance correction only. Significant colour grading changes are not included in the standard amendment round.
Re-edit requests must be submitted within 7 days of the delivery date. Requests received after 7 days from delivery will not be accepted.
Extensive retouching, composite work or significant alterations beyond minor amendments will be quoted and charged at £65 per hour with a minimum charge of one hour. This will be agreed in writing before work commences.
Additional rounds of amendments beyond the included single round will be charged at £65 per hour.
10. Download Links and File Archive
Download links remain active for 30 days from the delivery date. The client is responsible for downloading and storing all delivered files promptly.
After expiry, replacement download links can be issued subject to file availability for an archive retrieval fee of £30. The replacement link will remain active for a further 30 days.
Carl Bingham Property Presentation maintains a courtesy archive of completed projects. Whilst we aim to retain files for as long as possible we can only guarantee availability for 24 months from the original delivery date. After this period archived files may be permanently removed without notice.
11. Professional 360 Virtual Tours
Professional 360 virtual tours remain live for 12 months from delivery.
Should continued hosting be required after this period a reactivation fee of £30 will apply, extending the hosting period for a further 12 months from the date of reactivation.
Where a tour has been permanently removed from our hosting platform reactivation may not be possible.
12. Copyright and Image Licence
Carl Bingham Property Presentation retains full copyright of all images, video, floor plans and other media produced during the shoot.
Upon payment in full the client is granted a non-exclusive licence to use the delivered images and media for property marketing purposes only. This includes use on property portals, the agent's own website and social media in the context of marketing the specific property.
The licence applies only to the instructing client, cannot be transferred to another estate agent, business or third party without written permission, does not permit resale of the images, does not include RAW or working files and does not permit alteration that materially changes or misrepresents the property.
Any use beyond property marketing including use in advertising, editorial, third party publications or any commercial purpose unrelated to the specific property requires an additional licence agreed in writing.
Carl Bingham Property Presentation reserves the right to use all images, video and media produced for portfolio, marketing and social media purposes unless otherwise agreed in writing before the shoot. Requests to withdraw portfolio usage rights must be received in writing no later than 24 hours before the shoot date. Requests made after this point cannot be accepted.
13. Floor Plans
Floor plans are provided as a visual guide only. Whilst every reasonable effort is made to ensure accuracy, dimensions, layouts and measurements should not be relied upon for legal, contractual, architectural or valuation purposes.
14. Payment Terms — B2B Estate Agents and Business Clients
Invoices are issued on the same day as delivery or the following working day.
Payment is due within 5 working days of the invoice date.
A late payment charge of 10% of the invoice value will be applied to invoices outstanding beyond the payment due date.
Carl Bingham Property Presentation reserves the right to withhold future bookings for clients with outstanding invoices.
All images and media remain unlicensed until payment has been received in full.
15. Payment Terms — B2C Private Vendors and Individual Clients
A deposit of 50% of the agreed shoot fee is required to confirm the booking. No shoot date will be held without receipt of the deposit.
The remaining 50% balance is due on delivery of the final images. Images will not be released until the balance has been received in full. Where the balance remains unpaid Carl Bingham Property Presentation reserves the right to retain the deposit in full.
Payment is accepted via bank transfer or Stripe.
16. Client Responsibilities
By instructing Carl Bingham Property Presentation the client confirms that they have the authority to commission photography and marketing materials for the property and are responsible for obtaining any permissions required for access.
17. Limitation of Liability
Whilst every reasonable care is taken in providing our services our total liability shall not exceed the total amount paid by the client for the booking in question.
Carl Bingham Property Presentation shall not be liable for indirect or consequential losses arising from circumstances outside our reasonable control.
18. Force Majeure
Carl Bingham Property Presentation shall not be liable for delays or failure to perform services due to circumstances beyond our reasonable control including severe weather, illness, accidents, transport disruption, equipment failure or government restrictions.
In such circumstances both parties will make best efforts to agree an alternative date at the earliest opportunity.
19. Disputes
In the event of a dispute both parties agree to attempt resolution in good faith before pursuing any formal legal action. This agreement is governed by the laws of England and Wales.
20. Privacy
Personal information is processed in accordance with our Privacy Policy available on our website.
21. Changes to These Terms
Carl Bingham Property Presentation reserves the right to update these Booking Terms and Conditions at any time. The version published on our website at the time the booking is confirmed shall apply.
