Our goal is to provide a professional, reliable and consistent experience on every project. The standards we hold ourselves to are outlined in Our Service Promise. These Booking Terms & Conditions set out the contractual agreement that applies when booking our services.

By confirming a booking with Carl Bingham Photography, you agree to the following terms.

1. Booking Confirmation

A booking is confirmed once it has been accepted by Carl Bingham Photography in writing, including by email.

The agreed appointment date and time will be reserved exclusively for your property.

​

2. Services

Services may include, but are not limited to:

• Professional Property Photography

• Aerial Drone Photography

• Professional 360° Virtual Tours

• Floor Plans

The services to be provided will be confirmed at the time of booking or quotation.

3. Quotations & Pricing

All quotations are valid for 30 days unless otherwise stated.

Additional services requested after a booking has been confirmed may incur additional charges.

Travel outside our standard operating area may be subject to mileage or travel time charges, which will always be agreed in advance.

4. Payment Terms

Unless otherwise agreed in writing:

• Invoices are payable within 14 days.

• Commercial clients may be offered monthly invoicing by prior agreement.

• Late payments may incur statutory interest and recovery costs where permitted by law.

All images remain unlicensed until payment has been received in full.

5. Cancellation & Rescheduling

We appreciate that plans can change.

Should you need to cancel or rearrange your appointment, please provide as much notice as possible.

The following charges apply:

• More than 48 hours’ notice – No charge.

• Between 24 and 48 hours’ notice – 25% of the booking fee.

• Less than 24 hours’ notice – 50% of the booking fee.

• Cancellation after travel has commenced or upon arrival on site – 100% of the booking fee.

Where genuine emergencies arise, we will always seek to find a fair and reasonable solution.

6. Property Access

The client is responsible for ensuring that access to the property is available at the agreed appointment time.

If access cannot be gained, or the appointment is significantly delayed, additional charges may apply or the appointment may be treated as a late cancellation.

7. Property Preparation

To achieve the best possible results, the property should be fully prepared before the scheduled appointment.

This includes, where appropriate:

• Cleaning throughout.

• Beds made.

• Curtains and blinds opened.

• Appropriate lighting switched on.

• Personal items and clutter removed.

• Outdoor spaces presented.

Minor adjustments may be made during the appointment; however, Carl Bingham Photography is not responsible for cleaning, staging or preparing the property.

Where significant preparation is required on arrival, additional charges may apply or the agreed deliverables may not be achievable within the allocated appointment time.

8. Drone Photography

Drone photography is undertaken only where it is safe and lawful to do so.

Flights are subject to:

• UK Civil Aviation Authority regulations.

• Airspace restrictions.

• Temporary Flight Restrictions (TFRs).

• Weather conditions.

• GPS availability.

• Site safety assessments.

Booking drone photography does not guarantee aerial images if flying is not legally or safely possible.

Where this occurs, we will discuss suitable alternatives or arrange a return visit where appropriate.

9. Image Delivery

Standard delivery is within 48 hours of the appointment unless otherwise agreed.

Priority delivery may be available for an additional fee, subject to availability.

Images, floor plans and other agreed deliverables will be supplied digitally via a secure online download link.

10. Download Links & Archive

Download links remain active for 30 days from the delivery date.

After expiry, replacement download links can be issued, subject to file availability, for an Archive Retrieval Fee of £30.

The replacement link will remain active for a further 30 days.

Carl Bingham Photography maintains a courtesy archive of completed projects. Whilst we aim to retain files for as long as possible, we can only guarantee availability for 24 months from the original delivery date.

After this period, archived files may be permanently removed without notice.

11. Professional 360° Virtual Tours

Professional 360° Virtual Tours remain live for 12 months from delivery.

Should continued hosting be required after this period, a £30 reactivation fee will apply, extending the hosting period for a further 12 months from the date of reactivation.

Where a tour has been permanently removed from our hosting platform, reactivation may not be possible.

12. Image Selection & Editing

Carl Bingham Photography retains full creative control over image selection and editing.

Only the final edited images are supplied.

RAW files, unedited images and rejected images remain the property of Carl Bingham Photography and are not supplied.

Images are edited in accordance with our professional editing style to present the property accurately whilst maintaining a consistent standard across all projects.

13. Copyright & Image Licence

All photographs, floor plans and related media remain the copyright of Carl Bingham Photography.

Upon payment in full, the client is granted a non-exclusive licence to market the specific property photographed.

The licence:

• Applies only to the instructing client.

• Cannot be transferred to another estate agent, business or third party without written permission.

• Does not permit resale of the images.

• Does not include RAW files.

• Does not permit alteration that materially changes or misrepresents the property.

Carl Bingham Photography reserves the right to use commissioned work within its portfolio, website, social media and marketing unless otherwise agreed in writing before the appointment.

14. Floor Plans

Floor plans are provided as a visual guide only.

Whilst every reasonable effort is made to ensure accuracy, dimensions, layouts and measurements should not be relied upon for legal, contractual, architectural or valuation purposes.

15. Client Responsibilities

By instructing Carl Bingham Photography, the client confirms that they have the authority to commission photography and marketing materials for the property.

The client is responsible for obtaining any permissions required for access.

​

16. Limitation of Liability

Whilst every reasonable care is taken in providing our services, our total liability shall not exceed the total amount paid by the client for the booking.

Carl Bingham Photography shall not be liable for indirect or consequential losses arising from circumstances outside our reasonable control.

17. Force Majeure

Carl Bingham Photography shall not be liable for delays or failure to perform services due to circumstances beyond our reasonable control, including severe weather, illness, accidents, transport disruption, equipment failure or government restrictions.

18. Privacy

Personal information is processed in accordance with our Privacy Policy, available on this website.

​

19. Changes to These Terms

Carl Bingham Photography reserves the right to update these Booking Terms & Conditions at any time.

The version published on our website at the time the booking is confirmed shall apply.
